These Terms of Service ("Terms") govern your use of the ScubaCloud website and the ScubaCloud dive center management platform (together, the "Services") operated by Hernan Jorge Fuccillo ("we", "us", "our"). By creating an account or using the Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. By using the Services on behalf of a dive center or other organization, you represent that you have the authority to bind that organization to these Terms.

2. Your account

You are responsible for maintaining the confidentiality of your account credentials and for any activity under your account. Notify us immediately at info@scubacloud.co if you suspect unauthorized access.

3. Subscription

ScubaCloud offers a free trial and a monthly flat-fee subscription. You can cancel at any time from your account; cancellation takes effect at the end of the current billing month and there are no long-term commitments. Subscription payments are processed by Stripe.

4. Your data

You retain 100% ownership of all data you enter into ScubaCloud ("Customer Data"). You grant us a limited license to process Customer Data solely to provide and improve the Services. We will not share your Customer Data with third parties except to operate the Services or as required by law. See our Privacy Policy for full details.

5. Acceptable use

You agree not to: (a) interfere with or disrupt the Services; (b) attempt to access accounts or data that are not yours; (c) use the Services for any unlawful purpose; or (d) upload content that infringes the rights of others.

6. Availability and changes

We aim for high availability but do not guarantee that the Services will be uninterrupted or error-free. We may update, modify, or discontinue features at any time. Material changes affecting paid features will be communicated in advance.

7. Termination

You may cancel your account at any time from the app or by emailing us. We may suspend or terminate accounts that violate these Terms. On termination, you may export your Customer Data for 30 days, after which it will be deleted in line with our retention policy.

8. Liability

To the maximum extent permitted by law, the Services are provided "as is" without warranties of any kind. We will not be liable for indirect, incidental, or consequential damages. Our total liability for any claim arising from these Terms will not exceed the amount paid by you in the twelve months preceding the claim.

ScubaCloud is a management tool. You remain solely responsible for your dive center's operations, regulatory compliance, safety procedures, and decisions made using information from the Services.

9. Governing law

These Terms are governed by the laws of the Kingdom of Thailand, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms will be brought before the competent courts of Surat Thani Province, Thailand.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via a notice on this page and, where appropriate, by email. Continued use of the Services after an update constitutes acceptance of the revised Terms.
